How Do I recover my money?

Please reach us at marc@schiflaw.com if you cannot find an answer to your question.

Technically, yes. However, a "lawsuit" - as the name implies - is typically brought in a court of law and before a judge or legal magistrate. To recover losses caused by a registered investment advisor, like a brokerage firm that provides investment advice, a cause of action must be brought in an arbitration forum.  The organization that regulates investment advisors is the Financial Industry Regulatory Authority (FINRA). FINRA (previously NASD) provides arbitration forums of up to three arbitrators who will hear disputes filed by customers, normally for recovery of financial losses. Arbitrators have the authority to award customers their financial losses caused by broker fraud, negligence, or violations of industry standards of conduct. They can also award attorney's fees and costs incurred in bringing the dispute. Call us for a free consultation today!

Technically, no. However, FINRA arbitration is considered complex litigation. As a "self-regulating organization," FINRA it has its own set of rules that must be followed by the customer as well as the brokerage firm lawyers. Failing to abide by your obligations imposed by these rules could result in dismissal of your claim. Failing to recognize and pursue your rights outlined in the rules could result in unnecessarily losing your case.  You will definitely be going up corporate lawyers who know the laws and the rules. They are not acting in your interests. To the contrary, they will use every opportunity to confound your case, including having your case dismissed as soon as possible. So, you not only need a lawyer, but you need a lawyer team experienced in taking the fight to the brokerage or advisor firm; a team that knows how to hold them accountable for their negligence or intentional misconduct. Breach of Fiduciary Duty

Financial advisors have a fiduciary duty to their customers. Fiduciary duty is a duty of care and a duty of loyalty to the customer and to act always in the customer's best interests. We can help you assess whether the fiduciary duty was breached in your case, and whether your losses resulted from that breach.

Suitability

Investments in your portfolio should be suitable and reflect your risk tolerance, time horizon and liquidity needs depending on your age and life circumstances. We can determine whether the suitability rule has been breached and whether you can recover damages.

Churning

Financial Institutions offer different programs and products for their clients. Often, paying for each transaction could be costly. Making frequent trades with the intent to create commissions for your broker may constitute churning. Fee based accounts are typically advisory accounts where you don't pay commissions per trade.
